Eligibility
To create an account and enter into a binding contract with us, you must be at least 18 years old. If you are under 18 but at least 16 years old, you may use the Services only under the supervision of a parent or legal guardian who agrees to be bound by these Terms. If you are a resident of the European Economic Area, you must be over the age required by the laws of your country to enter into a binding contract or otherwise have verifiable consent from your parent or legal guardian. In such cases, the adult parent or guardian is the user and is responsible for all activities. Our Services are not intended for use by individuals under the age of 16.
The Services are for your personal, non-commercial use only and not for the use or benefit of any third party, except as explicitly permitted for a parent or guardian acting on behalf of a minor.
Accessing Your Results and Your Responsibilities
Our Services are designed for ease of use and do not require you to create a traditional account with a password.
To receive your personalized recommendations, you must provide a valid email address. We will deliver your results to this email address in the form of a unique, private URL that provides access to your results page. From this page, you will also have the option to download your results as a PDF.
By using the Services, you agree to the following responsibilities:
- Accurate Information: You must provide a true, accurate, and current email address. We are not responsible for any failure to receive your results or for results being sent to an incorrect email address if you provide inaccurate information.
- Confidentiality of Your Unique URL: The unique URL sent to your email provides direct access to your results, which may include sensitive personal information. You are solely responsible for maintaining the confidentiality and security of this link. Treat this link with the same care you would a password. Sharing this link will grant others access to your results.
- Responsibility for Access: You are responsible for all activities and access to your results that occur through your unique URL. We are not liable for any loss or damages arising from your failure to keep your unique URL confidential.
Terms of Sale
Placing an Order: To place an order for our Services, you must provide us with certain required information. This includes your full name, a valid email address, payment information, a facial photograph for our analysis, and your eyeglass prescription.
Prescription Validity: By placing an order for prescription eyewear, you hereby certify that you have a valid prescription issued by a qualified eye care provider. You represent and warrant that the prescription information you enter into the Service is valid, true, and matches exactly what your provider prescribed. We are not responsible for any issues arising from inaccurate or expired prescription information provided by you.
Payment: When you provide payment information, you authorize us (or our third-party payment processor) to charge your selected payment method for the total amount of your order. All payments are processed by a secure third-party payment processor.
Service Delivery: Our Services are delivered electronically. Upon completion of our analysis, your personalized recommendations will be sent to the email address you provided during the order process. This email will contain a unique URL to access your results. Delivery is considered complete when the email has been sent to the address you provided. You are responsible for providing a correct and active email address and ensuring our communications are not blocked by filters. We are not responsible for your failure to receive the results if the email address you provided is inaccurate or inaccessible.
Refund Policy: We are committed to your satisfaction. If you are not satisfied with the personalized recommendations you receive, you may request a refund by contacting us at **help@vizor.fit** within 7 days of receiving your results. As our Service is entirely digital, there is no physical product to return. We reserve the right to refuse refund requests in circumstances of suspected fraud or abuse of our policies.
Purchase Limits: We do not authorize the purchase of our products for commercial resale. We reserve the right to limit, cancel, or prohibit orders that, in our judgment, appear to be placed by dealers, resellers, or distributors.
Our Services and Disclaimers
No Medical Advice: Our Services, including any frame recommendations or analyses, are for informational purposes only and DO NOT CONSTITUTE PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. The information provided is not a substitute for an in-person examination and consultation with your optometrist or other qualified health provider. Always seek the advice of a professional for any medical questions.

Service Availability: We do not guarantee that the Services will be available at all times, uninterrupted, or error-free. We may modify, suspend, or discontinue any part of the Services at any time without notice.
Prohibited Conduct
You agree not to use the Services for any unlawful purpose or in any way that could harm, disable, or impair them. Prohibited activities include, but are not limited to:
- Using the Service for any unauthorized commercial purpose, including collecting user information for sending unsolicited emails or for resale of our products.
- Reproducing, duplicating, copying, selling, or reselling any portion of the Services.
- Using any robot, spider, or other automated means to access the Services, scrape content, or otherwise interfere with the proper working of the Services.

User-Submitted Content
For any feedback, photos, reviews, or other materials you submit to us or post on the Services ("User Content"), you retain ownership of your content. However, you grant Vizor.fit a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, and transferable license to use, reproduce, modify, distribute, create derivative works from, display, and otherwise use your User Content in connection with providing, promoting, and improving the Services. This includes use for research and development purposes.
You agree that any User Content you provide is non-confidential and that we are free to use it without compensation or obligation to you. You represent and warrant that you have all necessary rights to grant us this license and that your User Content does not violate the rights of any third party.
Copyright and DMCA Policy
We respect the intellectual property rights of others. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement on our Services, please provide our Copyright Agent with a written notice containing the following information as required by the Digital Millennium Copyright Act (DMCA):

Most concerns can be resolved quickly by contacting us. For any dispute, you agree to first contact us at legal@vizor.fit and attempt to resolve the dispute informally.
Binding Arbitration:
If a dispute is not resolved within 60 days of your initial contact, we each agree to resolve any claim arising out of or relating to these Terms or the Services by binding arbitration, rather than in court. The arbitration will be administered by a neutral arbitrator in accordance with the rules of an established alternative dispute resolution provider.
Class Action Waiver:
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND VIZOR.FIT AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL VIZOR.FIT, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR ACCESS TO OR USE OF THE SERVICES. OUR TOTAL LIABILITY TO YOU FOR ANY AND ALL CLAIMS RELATING TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, FOR USE OF THE SERVICES IN THE LAST 12 MONTHS.
Indemnification
You agree to defend, indemnify, and hold harmless Vizor.fit and its employees, directors, and agents from and against any and all claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.
Governing Law and Jurisdiction
Our Services are offered globally. We make no representation that the Services are appropriate or available for use in all locations. While our Services are accessible worldwide, we make no representation that they are appropriate or available for use in all locations. Those who access or use the Services from other jurisdictions do so at their own volition and are entirely responsible for compliance with all applicable local laws and regulations.
Except as otherwise provided in the Arbitration Agreement, these Terms and any dispute arising out of or related to them shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.
Subject to the Arbitration Agreement, you hereby irrevocably consent to the exclusive jurisdiction and venue of the state and federal courts located in and for the state of Delaware, for the resolution of any disputes.
Notwithstanding the foregoing, if you are a resident of the European Union, this shall not prevent you from bringing a claim in the courts of your country of residence, in accordance with applicable EU regulations.
Miscellaneous
Entire Agreement:
These Terms and our Privacy Policy constitute the entire agreement between you and Vizor.fit regarding the Services and supersede all prior agreements.
Severability:
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect.
Electronic Communications:
By using the Services, you consent to receive electronic communications from us. You agree that all notices, agreements, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
No Waiver:
Our failure to enforce any part of these Terms shall not constitute a waiver of our right to later enforce that or any other part of these Terms.
Changes to These Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will provide you with notice, such as by posting the updated Terms on our website and changing the "Effective Date" at the top. Your continued use of the Services after any changes constitutes your acceptance of the new Terms.
